Terms of Service

These Terms of Service ("Terms") govern use of ai.topsmm.uz (the "Service"), provided by TOPSMM LLC ("we", "us"). Using the Service (registering, connecting a channel, or using the cabinet) means you accept these Terms.

1. What the Service does

The Service is an AI-based customer-service assistant for businesses. It automatically replies to customer messages received via Telegram, Instagram (Direct messages and post comments), Facebook Messenger, and a website widget, using a knowledge base and service catalog the business owner provides, and hands off to a live operator when needed.

2. Account and channel connection

• A valid email and accurate information are required to register.
• You may only connect a Telegram bot, Instagram Business/Creator account, or Facebook Page that belongs to you or that you are formally authorized to manage. Connecting an account belonging to another person or business without authorization is prohibited.
• When connecting Instagram, the Service requests permissions such as: basic profile information, reading/sending Direct messages, reading/replying to post comments, and (if enabled) content publishing. This list may change over time based on Meta's requirements — the current list is shown during the connection flow itself.
• You are responsible for the security of your account (password, login credentials).

3. AI responses — possibility of error, and control

• AI is not perfect: automated replies may sometimes be incorrect, incomplete, or out of context. The Service does not guarantee 100% accuracy.
• The business owner can review every conversation in the cabinet, correct an AI reply, add it to the knowledge base, or take over a conversation manually as an operator.
• Variable information such as pricing/order status is only given via a live lookup (never cached), but you acknowledge some risk of error still remains.

4. Prohibited use

The following are prohibited through the Service:

• Sending spam or unsolicited bulk messages;
• Violating Meta's (Instagram/Facebook) Platform Policy and Terms of Use;
• Illegal, fraudulent, or customer-deceiving use;
• Damaging Service infrastructure or attempting unauthorized access.

Violating these rules may result in account suspension without notice.

5. User responsibility

Responsibility for the final content and replies sent to your customers (even when AI-generated) rests with the business owner — the Service is only an intermediary/tool. You are responsible for the accuracy of your own knowledge base and settings.

6. Payment and balance

The Service operates on a balance/credit system — usage is deducted from your balance based on consumption. Prices and plans are shown in the cabinet and may change without prior notice (changes apply to future usage only, not to amounts already spent).

7. Termination and cancellation

• You may request deletion of your account or disconnect a channel at any time (see the Data Deletion page).
• We may suspend accounts that violate these Terms, with or without notice, depending on severity (e.g., spam or a Meta policy violation).

8. Limitation of liability

The Service is provided "as is". To the extent permitted by law, TOPSMM LLC is not liable for indirect damages arising from errors in AI replies, temporary Service downtime, or outages of third-party services (Google, Meta, Telegram). Responsibility for the final content sent through the Service rests with the user as set out in Section 5.

9. Changes to these Terms

These Terms may be updated from time to time. We will notify you of material changes via the cabinet or email. Continuing to use the Service after updated Terms take effect constitutes acceptance of the new Terms.
